These Terms of Use (“Terms”) govern your access to and use of the websites, applications, and services operated by EscapeLife, Inc. (“EscapeLife,” “we,” “us,” or “our”), including escapelife.ai and the EscapeLife OS platform (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By using the Service, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@escapelife.ai if you suspect unauthorized access.

3. Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable law, regulation, or third-party rights.
• Use the Service to transmit spam, unsolicited messages, or harmful content.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the integrity or performance of the Service.

4. Intellectual Property

The Service and all content, features, and functionality — including but not limited to text, graphics, logos, software, and code — are owned by EscapeLife, Inc. or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted.

5. API and Developer Access

Access to the EscapeLife REST API is subject to these Terms and any additional API-specific documentation. You may not use the API to build competing products, resell API access, or exceed rate limits or quotas. We reserve the right to revoke API access at any time for violations.

6. Subscriptions and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method on file for all applicable fees. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to change pricing with reasonable notice.

7. Third-Party Integrations

The Service may integrate with third-party platforms, APIs, and services. Your use of those third-party services is subject to their own terms and privacy policies. EscapeLife is not responsible for the availability, accuracy, or practices of any third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESCAPELIFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO ESCAPELIFE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless EscapeLife, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Service after any changes constitutes your acceptance.
